Court keeps the lights on
A Utah judge has put Tyler Robinson’s secrecy push on ice. On Monday, Judge Tony Graf ruled that the public and the press have a presumptive right to access key court proceedings in the case involving the accused killer of Turning Point USA co-founder Charlie Kirk. That means important parts of the process will not be shoved behind closed doors just because the defense would prefer it that way. Robinson, 23, has been charged with seven counts, including aggravated murder, for the September 2025 shooting death of Kirk at a TPUSA event. The court made clear that transparency is the rule, not the exception. Funny how some people love “fairness” right up until the cameras show up.
Graf says secrecy was not justified
Graf explained that a party asking to close a preliminary hearing must prove that open proceedings would create a real risk of prejudice to a fair trial. He also said the defense must show there are no less restrictive ways to protect the jury process. In plain English, that means you do not get to hide everything just because public attention makes your case uncomfortable. The judge said those showings were not made here. His ruling also pointed to a bigger principle: public access helps keep confidence in the judicial process. That matters in a case this serious, especially when the public already knows the stakes are enormous and the allegations are grim.
Prosecutors face a separate challenge
Graf also addressed a different issue tied to a gag order he issued in September 2025. Robinson’s defense claims Utah County Attorney Jeff Gray and Deputy County Attorney Chris Ballard violated that order by speaking to several media outlets, including Fox News, USA Today, and TMZ. The judge said the defense made a sufficient preliminary showing under Utah law to justify more proceedings, but he did not find contempt at this stage. Instead, he set an evidentiary hearing for June 12, which means the matter is not going away quietly. The defense may keep tossing up roadblocks, but the court has so far made one thing clear: this case is not being handled in a back room for anyone’s convenience.
