Texas Fights Back Against “Open Borders” Biden – Attorney General Sues to Stop Joe’s Catch and Release

When President Joe Biden reversed his predecessor’s immigration policies, the Department of Homeland Security (DHS) almost immediately started reporting escalating encounter numbers.

Biden halted construction on the wall and made it more difficult for border authorities to deport border crossers. And ever since, Texas has been desperately fighting to keep their state — and this country — more secure.

Now, they’ve made another strong legal move against the current administration. This time, they’re targeting another infamous policy: “catch and release.”

Former President Trump was quick to tackle this problem. He implemented a policy known as “Remain in Mexico,” which said asylum seekers must stay in Mexico while awaiting the results of their case.

However, this is one of many policies to fall by the wayside since Biden took over.

Specifically, the administration announced in March that the decision-making process would shift to DHS, instead of federal judges. This would let massive amounts of migrants enter the U.S. while their claims were pending.

The Texas Tribune said that under this process, “asylum-seekers could be released into the country pending the outcome of their cases instead of being held in custody.”

This is exactly what Texas is trying to stop. As Breitbart reported:

Texas Attorney General Ken Paxton has once again sued President Joe Biden’s administration, this time over Biden’s attempt to codify the ‘catch and release’ policy into federal law.

AG Paxton has the support of the America First Legal Foundation in this matter, and their claim is clear: what the Biden administration is doing is illegal.

The plaintiffs in the lawsuit claim that Congress has laws in place for this process, and they don’t allow for “wholesale usurpation of powers.” Allowing officers to grant asylum at their leisure is “illegal,” they add.

America First Legal President Stephen Miller said the rule only exists to give millions of illegals green cards:

We are thrilled to be partnering with the State of Texas as outside counsel in filing this emergency motion to block implementation of Biden’s open borders rules.

This rule is designed to serve one goal: green cards for millions of newly-arriving illegal aliens. America First Legal will fight with the great Ken Paxton to defeat this lawless open borders monstrosity.

Since Biden entered the White House in January 2021, records show that nearly 1 million illegal foreign travelers crossed the border into the U.S.

Authorities have warned that gigantic segments of the border remain entirely open and the numbers keep surging. If the administration succeeds in lifting Title 42, the stats might reach historic proportions.

The border crisis remains one of the major topics that concern American voters. And perhaps one of the reasons Biden’s approval is so low is that his team has appeared to ignore the crisis entirely.

Key Takeaways:

  • Texas AG Ken Paxton filed a lawsuit against the Biden administration, to stop “catch and release” from becoming federal law.
  • The plaintiffs claim allowing DHS officers to grant asylum is illegal.
  • America First Legal Foundation President Stephen Miller claims the rule is made to give “millions of illegal aliens green cards.”
